Alternative Dispute Resolution (ADR) refers to any means of settling disputes outside of the courtroom. ADR typically includes arbitration, mediation, early neutral evaluation, and conciliation.

The two most common forms of ADR are arbitration and mediation. Arbitration is a simplified version of a trial.  Mediation is an even less formal alternative to litigation. Mediators are individuals who are trained in negotiation and bring opposing parties together to attempt to work out a settlement or agreement that both parties accept.

Two independent factors have given rise to the demand for ADR services in Minnesota:

  • The Minnesota court rules mandating non-binding ADR before trial, and
  • Continuing efforts by corporate counsel to reduce litigation expenses by exploring avenues of preliminary dispute resolution such as arbitration.

Floyd Siefferman is an American Arbitration Association certified arbitrator with extensive experience serving clients as both counsel and as a neutral arbitrator or mediator. He has over fifty years of experience and over 150 appellate cases in a wide range of practice areas including complex mass disaster litigation, business disputes, and personal injury matters. Due to his experience and expertise, Mr. Siefferman was retained as a consulting expert by the attorneys involved in the 35W bridge collapse case and is routinely consulted by other law firms in complex matters.
